U.S. Tourist Under the Visa Waiver Program Can Adjust Status in the U.S. on the Basis of Marrying a U.S. Citizen
Usually, a visitor who is traveling to the U.S. under the visa waiver program cannot adjust their status to a U.S. lawful permanent resident while they are in the U.S. However, there is an exception for this rule, and that is when the visitor is marrying a U.S. citizen. Our office has helped multiple clients to adjust their statuses to U.S. lawful permanent resident under this rule. Our most recent approved case was an Austrian citizen who came in to the U.S. as a tourist under the visa waiver program. He fell in love with a U.S. citizen and married her while he was visiting the U.S.
